Terms of Service

Please read these Terms of Service ("Terms") carefully before using Elite Alphabet at elitealphabet.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

Elite Alphabet is a premium web-based alphabet learning application for children. It provides interactive flashcards featuring luxury brand imagery across six categories (Cars, Jets, Watches, Bags, Perfumes, and Fashion), with voice pronunciation and progress tracking.

The Service is operated by Elite Alphabet and is accessible at elitealphabet.com. The Service is intended for educational and entertainment purposes only.

2. Eligibility

By subscribing, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is designed for use by children under the supervision of a subscribing parent or guardian. Children may not subscribe independently.

3. Subscription & Payment

Access to the full Service requires a paid annual subscription at the rate of USD $10.00 per year (or the current rate displayed at checkout). By subscribing, you authorise Elite Alphabet to charge your selected payment method for the subscription fee via our payment processor, Stripe.

  • Subscriptions are billed annually on the date of purchase.
  • Pricing is displayed in US Dollars. Currency conversion, if applicable, is handled by your payment provider.
  • We reserve the right to change the subscription price at any time. Any price change will take effect at the next renewal or when you start a new subscription.
  • Your subscription grants access to the Service for one year from the date of payment. Access is tied to the email address used at checkout.

4. No Refunds

All subscription payments are final and non-refundable. Once a subscription payment is processed, no refunds, credits, or partial refunds will be issued — including but not limited to: change of mind, non-use of the Service, dissatisfaction with content, technical issues on your device or network, or early cancellation.

If you believe you have been charged in error, contact us at support@elitealphabet.com within 7 days and we will review the matter at our sole discretion.

We strongly encourage you to try the free preview features available on the home page before subscribing.

5. Service Availability & Continuity

We do not guarantee that the Service will be available forever, continuously, or without interruption.

Specifically:

  • No uptime guarantee: The Service is provided on a best-efforts basis. We do not guarantee any specific uptime percentage or availability.
  • Scheduled maintenance: The Service may be temporarily unavailable during planned maintenance windows. We will endeavour to minimise disruption but are not required to give advance notice.
  • Unplanned downtime: Technical issues, server failures, third-party outages, or events beyond our control may cause unplanned interruptions.
  • Service discontinuation: We reserve the right to modify, suspend, or permanently discontinue the Service, or any part of it, at any time. If we choose to permanently discontinue the entire Service, we will make reasonable efforts to provide at least 30 days' notice via the website or registered email addresses. No refunds will be issued upon discontinuation unless required by applicable law.
  • Feature changes: Features, categories, content, and functionality may be added, changed, or removed at any time without notice.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Service will be error-free, secure, or free from viruses or other harmful components.
  • Warranties regarding the accuracy, completeness, or currency of any content within the Service.
  • Warranties that any specific educational outcome will result from use of the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Elite Alphabet and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, loss of use, or interruption of business — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount you paid for the current subscription period in which the claim arose.

8. Intellectual Property

All content on the Service — including text, graphics, user interface, code, and the "Elite Alphabet" brand name and logo — is the property of Elite Alphabet and is protected by applicable intellectual property laws. You may not reproduce, redistribute, or create derivative works from any part of the Service without our prior written consent.

Third-party brand names and trademarks referenced in the app (e.g., Audi, Rolex, Chanel) are the property of their respective owners. Their appearance in the Service does not imply any affiliation, sponsorship, or endorsement.

9. Acceptable Use

You agree not to:

  • Share your subscription access with others or resell access to the Service.
  • Attempt to circumvent, reverse-engineer, or bypass any access control or security measure.
  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Scrape, harvest, or extract content from the Service by automated means.

10. Cookies & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Third-Party Services

The Service uses Stripe for payment processing. Your interaction with Stripe is governed by Stripe's own Terms of Service. We are not responsible for the practices of any third-party service.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date above when changes are made. Continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation between the parties before any formal proceeding is initiated.
